The federal government, citing the Supremacy Clause, is challenging California’s Proposition 12, which sets minimum space standards for pigs, hens, and calves. Approved by voters in 2018, Prop 12 requires producers selling in California to meet these standards—even outside the state. The DOJ filed a 16-page complaint on July 9, arguing federal law overrides Prop 12. The law has survived past court challenges but faces a new federal test now.
